Welcome to LetsHabit ("LetsHabit," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the LetsHabit mobile application, website, and related services (collectively, the "Services"). By creating an account or using the Services, you agree to be bound by these Terms and our Privacy Policy (the "Privacy Policy"), which explains how we collect, use, and share information.
If you do not agree to these Terms or the Privacy Policy, do not use the Services.
Minimum Age. You must be at least 13 years old (or the age of digital consent in your jurisdiction, if higher) to use the Services. If you are under 18, you represent that you have permission from a parent or legal guardian, who accepts these Terms on your behalf and is responsible for your use.
Account Registration. You agree to provide accurate, current information and to keep it updated. You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately if you suspect unauthorized use.
One Person, One Account. Unless we approve otherwise, you may not create or maintain multiple accounts for the same individual.
Purpose. LetsHabit is a habit‑tracking app with optional photo verification and motivational features (e.g., reminders, streaks, XP/levels, achievements, and push notifications). You may upload photos to confirm habit completion.
No Medical, Legal, or Professional Advice. The Services are for general productivity and motivation. We do not provide medical, mental‑health, legal, or other professional advice. Do not rely on the Services for diagnosis or treatment. If you need help, consult a qualified professional.
Device Permissions. Some features require permissions (e.g., camera, photos, notifications). You can manage these in your device settings, though disabling permissions may limit functionality.
Premium Features. Certain features are available via a paid subscription (“LetsHabit Premium”). Pricing and available plans are shown in‑app and may vary by region and platform.
Auto‑Renewal. Subscriptions auto‑renew until canceled. Your payment method will be charged each billing period unless you cancel at least 24 hours before renewal.
Where You Are Billed. Purchases made through the Apple App Store or Google Play are billed by those stores. We use trusted partners (e.g., RevenueCat) for subscription management.
Trials & Promotions. Free trials and promos, if offered, convert to paid unless canceled before the trial ends. Eligibility may vary.
Cancellation. You can cancel anytime via your device’s subscription settings (e.g., iOS: Settings > Apple ID > Subscriptions; Android: Google Play > Payments & subscriptions). Deleting the app does not cancel a subscription.
Refunds. All sales are final except where required by law. For App Store/Google Play purchases, refunds are handled by the store and subject to its policies.
Price Changes. We may change prices or features of plans prospectively with notice as required by law. Ongoing subscriptions will receive notice through the applicable platform.
Your Ownership. You retain ownership of photos and other content you submit ("User Content").
License to Operate the Services. Solely for operating and improving the Services (including image verification, quality assurance, security, and analytics), you grant LetsHabit a worldwide, non‑exclusive, royalty‑free, transferable, and sublicensable license to host, store, process, display, and create derivative works from your User Content.
Retention. We describe how long we keep User Content in our Privacy Policy. You can delete content in‑app where available; residual copies may persist in backups for a limited time.
Feedback. If you send ideas or suggestions, you grant us a perpetual, irrevocable license to use them without obligation to you.
You agree not to:
Use the Services for any unlawful purpose or in violation of any law or regulation.
Upload content that is illegal, infringing, deceptive, hateful, harassing, threatening, or otherwise harmful.
Upload adult sexual content, nudity, or exploitative content, especially involving minors (zero tolerance; we report to authorities as required by law).
Upload content that you do not have the right to share (e.g., others’ personal data, copyrighted works without permission).
Interfere with, disrupt, or attempt to compromise the security or integrity of the Services, including reverse‑engineering or scraping without permission.
Attempt to circumvent technical limitations, quotas, or subscription restrictions.
Impersonate any person or entity or misrepresent your affiliation.
We may take appropriate action (including removal, suspension, or termination) if you violate these Terms.
Your privacy is important to us. Our Privacy Policy explains what data we collect (e.g., account info, usage data, device and notification tokens, and optional photos for habit verification), how we use it (e.g., to provide features, maintain security, analyze performance), and when we share it with service providers (e.g., Firebase, RevenueCat, analytics). By using the Services, you agree to our data practices as described in the Privacy Policy.
The Services may integrate third‑party platforms (e.g., sign‑in providers, app stores, notification services, analytics, image verification pipelines). Your use of those services may be subject to their terms and privacy policies. We are not responsible for third‑party services.
Our IP. The Services, including software, UX, text, graphics, logos, and trademarks, are owned by LetsHabit or its licensors and are protected by law.
Your Limited License. We grant you a limited, revocable, non‑exclusive, non‑transferable license to use the Services for personal, non‑commercial purposes in accordance with these Terms.
No Reverse Engineering. You may not copy, modify, distribute, sell, lease, or reverse engineer any part of the Services except to the extent such restrictions are prohibited by law.
Productivity Only. The Services are provided to help with habits and motivation. Results vary by individual.
No Warranty. THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not guarantee that the Services will be uninterrupted, secure, or error‑free.
To the maximum extent permitted by law, LetsHabit and its affiliates, officers, employees, agents, partners, and licensors are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, arising from or relating to your use of the Services, even if we knew or should have known of the possibility of such damages.
Where liability cannot be excluded, our aggregate liability shall not exceed the greater of (a) US $50 or (b) the amounts you paid to us for the Services in the six (6) months preceding the claim. Some jurisdictions do not allow certain limitations; these may not apply to you.
You agree to indemnify and hold harmless LetsHabit and our affiliates, officers, agents, and employees from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your use of the Services, or your violation of these Terms or applicable law.
You may stop using the Services at any time. We may suspend or terminate your access for any violation of these Terms or where required by law. Upon termination, Sections intended to survive (including ownership, licenses to Feedback, IP, warranty disclaimers, limitations of liability, indemnity, and governing law) will continue to apply.
We may modify the Services or these Terms at any time, for example to reflect changes in features, law, or business practices. We will provide notice as required by law (e.g., in‑app notice, email, or app store notes). Your continued use after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of [Commonwealth of Virginia, USA] without regard to conflict of law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Loudoun County, Virginia, for any dispute that is not subject to arbitration (if applicable in your jurisdiction).
Optional Arbitration Clause (replace or remove as desired): Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by JAMS under its rules. You and LetsHabit waive the right to a jury trial and to participate in a class action. You may opt out within 30 days of first acceptance by sending written notice to [contact email and address].
You may not use or access the Services if you are located in a jurisdiction under US embargo or if you are on any US government list of prohibited or restricted parties. You agree to comply with all applicable export and sanctions laws.
Entire Agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Services.
Severability. If any provision is found unenforceable, it will be replaced with a valid term that best reflects the original intent; the remainder will stay in effect.
No Waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
Assignment. You may not assign or transfer these Terms; we may assign as part of a merger, acquisition, or asset sale.
Notices. We may provide notices via the Services, email, or app store updates.
